Termeni de utilizare
1. About These Terms
These Terms & Conditions govern access to the Powerlift website and all orders placed through our online store.
Throughout these Terms, “Powerlift”, “we”, “us”, and “our” refer to Powerlift and the business operating this website.
Powerlift supplies products intended strictly for legitimate research, laboratory, analytical, and educational purposes. Products designated for research use are not offered or supplied for personal use, human consumption, animal consumption, medical use, or therapeutic use.
By accessing our website or placing an order, you agree to these Terms & Conditions together with our Privacy Policy, Shipping Policy, Refund & Return Policy, and other applicable policies displayed on our website.
If you do not agree with these Terms, you must not use the website or place an order.
Nothing in these Terms excludes or restricts rights that cannot lawfully be excluded under applicable legislation.
2. Eligibility and Purchaser Representations
You must be at least 18 years old, legally capable of entering into a binding contract, and legally permitted to purchase and receive the products ordered.
By placing an order with Powerlift, you represent and confirm that:
- You are at least 18 years of age.
- You are purchasing research-designated products exclusively for a legitimate research, laboratory, analytical, or educational purpose.
- You are not purchasing research-designated products for personal use or human or animal consumption or administration.
- You possess the appropriate knowledge, facilities, training, and authority necessary to receive, store, handle, and use the products safely and appropriately.
- Your purchase, importation, receipt, possession, storage, handling, and intended research use comply with all laws and regulations applicable to you and the delivery destination.
- You will not use, supply, market, resell, or otherwise make the products available for an unauthorised or unlawful purpose.
- All information supplied when placing your order is accurate, complete, and current.
Powerlift may request reasonable information necessary to verify age, identity, location, or compliance with these requirements.
We reserve the right to refuse, suspend, or cancel an order where we cannot complete necessary checks or where we reasonably believe that an order may be inconsistent with these Terms or applicable law.
3. Research Use Only
Unless expressly stated otherwise by Powerlift in writing, research-designated products available through our website are supplied strictly for research purposes only.
They are not intended, marketed, or supplied for personal use or human or animal consumption.
Research products must not be:
- Consumed, swallowed, inhaled, injected, administered, or otherwise introduced into the human or animal body.
- Applied to humans or animals.
- Used for self-experimentation or personal purposes.
- Used to diagnose, treat, cure, mitigate, or prevent any disease, injury, or medical condition.
- Used as or incorporated into medicines, pharmaceuticals, food, beverages, dietary supplements, cosmetics, or veterinary products.
- Used as a substitute for a medicine or healthcare product.
- Resold, relabelled, repackaged, advertised, or supplied for human or animal use.
- Used in violation of pharmaceutical, sporting, customs, controlled-substance, professional, or other applicable regulatory requirements.
- Used for any unlawful or unauthorised purpose.
Product names, chemical references, scientific information, specifications, descriptions, images, and other catalogue information are provided solely for identification, technical information, and legitimate research purposes.
The appearance of a compound, ingredient, chemical name, or other scientific information on our website does not constitute a recommendation or instruction for personal use.
Nothing published by Powerlift constitutes medical advice, treatment guidance, prescribing information, pharmaceutical advice, or a representation that a research product has been approved for human or veterinary use.
4. Purchaser Responsibility
Before placing an order, purchasers are responsible for independently determining whether they may lawfully purchase, import, receive, possess, store, handle, and use a particular product for their intended research purpose.
Laws and regulations differ between countries and jurisdictions. The availability of a product on our website does not constitute a representation that the product can lawfully be purchased or imported in every location.
By completing an order, you confirm that you have conducted any regulatory or legal checks necessary for your jurisdiction.
Powerlift reserves the right to restrict products or destinations and to refuse orders where we reasonably believe supply may be unlawful or inconsistent with the research-only nature of our products.
5. Orders and Contract Formation
Submitting an order constitutes an offer to purchase the products contained in your basket subject to these Terms.
An automated order acknowledgement or payment confirmation confirms that we have received your order but does not necessarily mean that it has been accepted.
A binding contract is formed when we confirm acceptance or dispatch your order, whichever occurs first.
We may refuse or cancel an order before dispatch where:
- A product is unavailable.
- An obvious pricing or product-information error has occurred.
- Payment cannot be authorised.
- A transaction is identified as potentially fraudulent or high risk.
- Delivery information is incomplete or inaccurate.
- We cannot deliver to the requested destination.
- Required verification or compliance checks cannot be completed.
- Purchase, supply, delivery, possession, or importation may be restricted or unlawful.
- We reasonably believe that a research product is being purchased for personal use, human or animal consumption, administration, resale for such purposes, or another unauthorised purpose.
- We reasonably suspect fraud, abuse, or another breach of these Terms.
Where payment has already been collected for an order that we subsequently decline, the applicable amount will normally be refunded to the original payment method.
6. Product Information and Availability
We take reasonable care to ensure that product names, quantities, specifications, descriptions, and images displayed on our website are accurate.
Minor differences may occur due to packaging changes, manufacturing tolerances, photography, screen settings, or product updates.
Product availability is not guaranteed until an order has been accepted.
We may modify, replace, suspend, or discontinue products where necessary.
Purchasers are responsible for reviewing available product information and determining whether a product is suitable for their intended lawful research application before ordering or handling it.
No product information displayed on our website should be interpreted as guidance concerning personal consumption, dosage, administration, or therapeutic use.
7. Prices, Taxes and Payment
Prices are displayed in the currency shown or selected on our website.
The amount payable to Powerlift, including shipping charges and any taxes collected directly by us, will be displayed before you submit your order.
International orders may be subject to customs duties, import taxes, VAT/GST, brokerage charges, handling fees, or other charges imposed by the destination jurisdiction.
Unless expressly stated otherwise during checkout, such charges are the responsibility of the recipient.
We reserve the right to correct genuine and obvious pricing errors before accepting an order.
Payments are processed through approved third-party payment providers, which may conduct independent security, identity, and fraud-prevention checks.
8. Shipping, International Delivery and Customs
Available shipping methods, estimated delivery times, charges, and destinations are displayed on our website or during checkout.
Delivery timeframes are estimates unless expressly stated otherwise.
You must provide complete and accurate delivery information.
International purchasers are responsible for confirming that the products ordered can lawfully be imported, received, possessed, and used for their intended research purposes within the destination jurisdiction.
Powerlift will not falsify customs documentation, intentionally misdescribe goods, artificially reduce declared values, or declare commercial purchases as gifts to avoid taxes, customs requirements, or regulatory restrictions.
We may refuse or cancel an order where lawful delivery cannot reasonably be completed.
9. Returns, Cancellations and Refunds
Returns, cancellations, and refunds are governed by our separate Refund & Return Policy and any mandatory rights applicable to the transaction.
Where permitted by law, products returned because the purchaser has changed their mind must generally remain unused, unopened, undamaged, and in their original sealed packaging.
Certain sealed products may be excluded from change-of-mind returns once their seal has been broken where applicable law permits such an exclusion.
Opening, using, altering, contaminating, damaging, or improperly storing a product may affect return eligibility.
Nothing in this section removes mandatory rights concerning products that are faulty, damaged, incorrectly supplied, or materially different from their description.
Approved refunds will normally be returned to the original payment method.
10. Damaged, Faulty or Incorrect Products
Please inspect your order promptly after delivery.
If a product arrives damaged, faulty, incomplete, or different from the product ordered, contact us as soon as reasonably possible.
We may request information reasonably necessary to investigate the issue, including:
- Your order number.
- A description of the issue.
- Photographs or video of the product.
- Photographs of the packaging and shipping label where relevant.
Depending on the circumstances and applicable law, an appropriate remedy may include a replacement, refund, repair, price reduction, or another legally required remedy.
Mandatory legal rights concerning faulty, damaged, or misdescribed products remain unaffected.
11. Safe Handling and Storage
Research products should be handled only by persons with appropriate knowledge, training, facilities, and safety procedures.
Purchasers are responsible for appropriate storage, handling, transportation, security, and disposal following receipt.
Research products must be kept securely away from children, animals, and unauthorised persons.
Purchasers should carry out their own appropriate risk assessments and follow relevant laboratory, occupational safety, environmental, and disposal requirements.
Powerlift does not provide instructions for human or animal consumption, administration, dosage, or personal use.
12. Prohibited Use
You must not use Powerlift products or services:
- For human or animal consumption or administration.
- For personal or self-experimental use.
- For medical, therapeutic, diagnostic, or veterinary purposes.
- For unlawful manufacturing or preparation.
- To circumvent pharmaceutical, customs, sporting, or controlled-substance regulations.
- For resale or redistribution for an unauthorised purpose.
- In any manner prohibited by applicable law.
If we reasonably believe that an order or account is connected with prohibited use, we may refuse orders, restrict access, cancel transactions before dispatch, or take other reasonable action necessary to protect Powerlift and comply with applicable requirements.
13. No Medical or Professional Advice
Powerlift does not provide medical, pharmaceutical, therapeutic, prescribing, veterinary, legal, or regulatory advice.
Information on our website is provided for general product identification and research-related informational purposes.
No statement, product description, article, review, communication, or other material appearing on our website should be interpreted as recommending that a research product be consumed or administered.
You should not rely on information provided by Powerlift to make decisions concerning medical treatment, personal supplementation, drug administration, or other personal use.
14. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
To the maximum extent permitted by applicable law, Powerlift will not be responsible for losses resulting from:
- Human or animal consumption or administration of a research product.
- Personal or self-experimental use.
- Unlawful or unauthorised use.
- Failure to comply with applicable laws or regulations.
- Improper handling, storage, transportation, modification, contamination, or disposal.
- Use contrary to the restrictions clearly stated on our website or product packaging.
- Customs or import restrictions arising from requirements applicable to the purchaser or destination, except where liability cannot legally be excluded.
Where an order is made wholly or mainly for business or professional purposes, we will not, to the extent permitted by law, be responsible for indirect or consequential losses, lost profits, lost revenue, business interruption, anticipated savings, goodwill, or data.
15. Intellectual Property
The Powerlift name, logos, branding, product artwork, graphics, photographs, text, website design, and other original materials are owned by or licensed to Powerlift and may be protected by applicable intellectual-property laws.
Access to our website does not transfer ownership of any intellectual property to you.
Website materials may not be copied, reproduced, modified, distributed, scraped, republished, sold, or commercially exploited without prior permission except where permitted by law.
16. Reviews and Submitted Content
Reviews, comments, photographs, and other content submitted to Powerlift must be genuine, lawful, and relevant.
Content must not:
- Promote or encourage human or animal consumption of research products.
- Contain dosage or administration instructions for research products.
- Promote personal or self-experimental use.
- Make unauthorised medical or therapeutic claims.
- Encourage unlawful activity.
- Contain fraudulent, threatening, abusive, or discriminatory material.
- Violate another person's privacy or intellectual-property rights.
- Contain spam, malware, or malicious links.
We reserve the right to moderate or remove submitted content that conflicts with these Terms, applicable law, or the research-only nature of our products.
By submitting content for publication, you confirm that you have the right to provide it and grant Powerlift a non-exclusive, worldwide, royalty-free licence to display and reproduce that content in connection with our website, services, and marketing, subject to applicable law.
17. Website Access and Acceptable Use
We may update, restrict, suspend, or temporarily withdraw all or part of our website for operational, technical, security, or legal reasons.
We do not guarantee that access will always be uninterrupted or error-free.
You must not:
- Attempt to gain unauthorised access to our website or systems.
- Introduce viruses, malware, or malicious code.
- Interfere with website operation or security.
- Scrape or systematically extract website content without permission.
- Impersonate another person or provide fraudulent information.
- Circumvent age, location, purchase, or compliance restrictions.
- Use our website in connection with unlawful activity.
18. Events Outside Our Reasonable Control
Powerlift will not be responsible for delays or failures caused by circumstances outside our reasonable control.
Such circumstances may include severe weather, natural disasters, transport disruption, carrier failures, customs delays, industrial action, governmental restrictions, changes in law or regulation, cyber incidents, utility or internet outages, public-health emergencies, or similar events.
Where an event materially affects an accepted order, we will take reasonable steps to minimise disruption where practicable.
Any mandatory cancellation or refund rights remain unaffected.
19. Privacy
Our collection and processing of personal information is governed by our Privacy Policy.
Personal information may be processed where necessary to manage orders, payments, delivery, fraud prevention, compliance, customer support, and other legitimate business activities as explained in that policy.
20. Governing Law and International Orders
These Terms are governed by the law applicable to the business entity operating Powerlift, subject to mandatory protections that may apply to purchasers in other jurisdictions.
For international transactions, purchasers remain responsible for compliance with laws and regulations applicable to the purchase, importation, possession, storage, handling, and intended research use of the products in their jurisdiction.
Nothing in these Terms is intended to remove mandatory legal rights that cannot lawfully be excluded.
Where legally permitted, disputes relating to these Terms or an order will be handled by the courts having jurisdiction over the business operating Powerlift.
21. Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes to our products, website, operations, policies, or applicable requirements.
Updated Terms will take effect when published on our website unless otherwise stated.
The version in effect when an order is accepted will generally govern that order.
